Gloria Galindo-Zepeda, who has lived in the village for 15 years, fell on Sept. 25 while crossing the street at Broadway and Lincoln Street and had to be taken to the hospital for treatment, said her attorney Michael Levitz.
Galindo-Zepeda had been out to lunch and shopping in the area when she fell, Levitz said.
"She knows the area well and didn't see any signs or barriers blocking the area when she crossed the street," Levitz said.
The village has been repaving and performing other work in the area, and there are yellow cones in the area, but no signs or barriers of any kind.
The main issue for Galindo-Zepeda is that no wants to take responsibility for her injuries, Levitz said.
"At this point, it is early on so each municipality- village, town, county- are pointing fingers at each other," he said.
Village Clerk Judy Curcio said the matter is being handled by the village's insurance company Traveler's Insurance. Traveler's said they don't comment on pending ligation.
Galindo-Zepeda, who is facing surgery, and also suffered torn tendons, and other injuries, just wants someone to care about what happened to her and to make sure it doesn't happen to others.
"Where are the signs?" Levitz said. "There's nothing, not even a construction underway sign."
The attorney added that Galindo-Zepeda, who is on Medicaid, is facing high medical bills.
"Someone is responsible for whoever is doing the work and not taking the appropriate safety measures, he added.
Officials from the Rockland County attorney's office did not return calls.
